NYC Administrative Code § 27-2018.1 – Bedbug Notice and Disclosure Requirements

NYC Bedbug Law: Requirements for Landlords and Building Owners

New York City Administrative Code § 27-2018.1 establishes bedbug infestation disclosure and notification requirements for residential property owners. The law is designed to protect tenants by providing information about previous bedbug infestations and educating residents about bedbug prevention, identification, and treatment.

NYC landlords and property managers must understand the difference between providing bedbug infestation history to new tenants and distributing or posting annual bedbug information in residential buildings.

1. Bedbug Infestation History Disclosure to New Tenants

Under NYC Administrative Code § 27-2018.1(a), residential property owners must provide new tenants with a written notice disclosing the bedbug infestation history of the apartment and building for the previous year.

This disclosure must be provided when entering into a vacancy lease.

The disclosure helps prospective tenants understand whether bedbug infestations have occurred in the apartment or elsewhere in the building during the applicable reporting period.

Providing an annual bedbug notice in the building lobby does not replace the separate requirement to disclose infestation history to new tenants.

2. Annual Bedbug Notice Posting Requirements

Under NYC Administrative Code § 27-2018.1(c), owners of multiple dwellings must make annual bedbug information available to tenants.

Owners may comply by either:

  1. Providing the required documents to tenants with each new lease and lease renewal.

  2. Posting the required documents in a prominent public location within the building.

For buildings using the posting option, two documents must be displayed:

Document 1: Annual Bedbug Infestation Report

A copy of the most recent annual bedbug infestation report electronically submitted to the NYC Department of Housing Preservation and Development (HPD) under Administrative Code § 27-2018.2.

Document 2: Bedbug Prevention and Information Notice

An informational notice approved by the NYC Department of Health and Mental Hygiene (DOHMH), explaining how to prevent, detect, and eliminate bedbug infestations.

Both documents must be available as required by law.

3. Which NYC Buildings Must Comply?

The annual bedbug reporting requirements generally apply to multiple dwellings containing three or more residential units.

Examples include:

  • Three-family residential buildings

  • Apartment buildings with six or more units

  • Large residential rental properties

  • Covered condominium buildings

  • Covered cooperative apartment buildings

One- and two-family residential properties are generally not subject to the annual reporting requirement under § 27-2018.2, although separate tenant disclosure obligations may apply.

Commercial-only properties are not subject to these residential bedbug reporting requirements.

4. NYC Annual Bedbug Reporting Requirements

Under NYC Administrative Code § 27-2018.2, covered property owners must submit an annual bedbug infestation report to HPD.

The annual reporting period runs from November 1 through October 31.

The filing period is December 1 through December 31.

For the 2026 reporting year:

Reporting Period: November 1, 2025 – October 31, 2026

Filing Deadline: December 31, 2026

Property owners must submit the annual report even if no bedbug infestations occurred during the reporting period.

The report generally includes:

  • Total number of dwelling units in the building

  • Number of units with reported bedbug infestations

  • Number of units where bedbug eradication measures were employed

  • Number of units that experienced reinfestation after treatment

Owners choosing the posting option must also comply with the applicable posting and recordkeeping requirements.

5. Where Should the Bedbug Notice Be Posted?

NYC Administrative Code § 27-2018.1(c) requires posting in a prominent public location within the building when the owner selects the posting method.

Common locations include:

  • Main residential building lobby

  • Near the building mailboxes

  • Main entrance common area

  • Other prominent common areas accessible to residents

The law does not establish a specific mandatory sign dimension, frame material, or mounting height for the annual bedbug documents.

The important requirement is that the correct documents are prominently displayed and accessible to residents.

6. Are Permanent Bedbug Signs Required?

NYC law requires the applicable bedbug information to be provided or posted. It does not require a particular type of permanent metal, plastic, or engraved bedbug sign.

A generic sign displaying only "BEDBUG NOTICE" or "NYC ADMINISTRATIVE CODE § 27-2018.1" is not sufficient by itself to satisfy the annual information requirements.

Building owners who choose the posting option must display the actual required documents.

A wall-mounted notice frame or document holder can help property managers keep these documents organized, protected, and accessible.

Because the annual infestation report changes each year, a replaceable document holder is a practical option.

7. Bedbug Notice Frames and Document Holders

Building owners and property managers may use wall-mounted frames to display their required bedbug information.

A document frame can help:

  • Keep notices visible in common areas

  • Protect printed documents from routine handling

  • Maintain a professional appearance in building lobbies

  • Allow replacement of annual reports

  • Organize building compliance notices near mailboxes or management information boards

Frames should be selected based on the dimensions of the documents being displayed. If two documents are required, the display must accommodate both.

Important: Purchasing or installing a frame does not automatically establish legal compliance. The owner remains responsible for obtaining, displaying, and updating the required documents.

8. Penalties for Failure to Comply

Failure to comply with NYC bedbug disclosure, reporting, or posting requirements may result in enforcement action.

Potential issues include:

  • Failure to provide required infestation history to a new tenant

  • Failure to file the annual bedbug infestation report

  • Failure to distribute or prominently post the required documents

  • Failure to address actual bedbug infestations

A tenant who does not receive the required vacancy-lease disclosure may submit a written complaint to the New York State Division of Housing and Community Renewal (DHCR).

HPD may separately enforce applicable annual reporting and housing maintenance requirements.

Actual bedbug infestations are treated as Class B housing maintenance violations and are subject to applicable correction deadlines.

9. Frequently Asked Questions

Is a bedbug notice required in every NYC apartment building?

Owners of covered multiple dwellings must comply with annual bedbug reporting and notification requirements. The law provides options for distributing or posting the required information.

Can the annual bedbug report be posted near the mailboxes?

Yes, a prominent common area near the mailboxes may be suitable, provided the location satisfies the applicable public posting requirement.

Does a bedbug sign alone satisfy NYC law?

No. A generic bedbug sign does not replace the required annual infestation report and approved educational notice.

Must the bedbug report be updated every year?

Yes. Covered property owners must file an annual report and ensure that the required information made available to tenants is current.

Is there a required size for a bedbug notice frame?

The statute does not prescribe a specific frame size. Owners should use a frame that properly accommodates the required documents and allows them to remain readable.

Do landlords need to provide bedbug history even when the building has no infestations?

Yes. The applicable disclosure and reporting requirements are not eliminated simply because no infestations were reported.
