 Protect Your Child from Lead Poisoning and Window Falls

It is required by law that landlords deliver to their tenants, the annual notice no earlier than January 1st and no later than January 16th by first class mail addressed to the tenant at the dwelling unit, hand delivery to the tenant at the dwelling unit, or by enclosure with the rent bill.

What is the annual notice? New York Law requires landlords in multiple dwelling buildings (buildings with three or more apartments) to send a notice to tenants or occupants each year. The notice asks tenants about the ages of children living in the apartment and contains a form that tenants must fill out and return to the landlord by February 15 of each year. The notice also contains information about window guards and lead paint hazards.

Local Law 11 of 1998 (Facade, retaining wall inspections)-February 21: Compliance deadline for owners of all buildings over six stories to inspect the exterior walls and file a facade inspection report. Cycle 9 begin February 21, 2021 and runs through February 21, 2025. Sub-cycle 9A – Building block ending in 4, 5, 6 and 9 must file between February 21, 2020 through February 21, 2022.

 

FEBRUARY 28

NYC ANNUAL BEDBUG FILING IS DUE: PROPERTY OWNERS: COMPLETE YOUR ANNUAL BEDBUG FILING. THE DEADLINE TO COMPLETE THE FILING IS FEBRUARY 28,2019 Please note that after this current filing period, property owners will be required to file between December 1 and December 31.

NOTIFY DOHMH IN WRITING ABOUT NON-Responsive TENANTS TO WINDOW GUARDS FORM REQUEST: Local Law 57 of 2011 authorizes HPD to issue violations for failure to install proper window guards, and to seek penalties for noncompliance.  The window guard law also requires owners to send an annual notice to tenants of multiple dwellings (buildings of 3 or more apartments) to determine if window guards are required

2016 LL84 Benchmarking due

The NYC Benchmarking Law requires owners of large buildings to annually measure their energy and water consumption in a process called benchmarking. The law standardizes this process by requiring building owners to enter their annual energy and water use in the U.S. Environmental Protection Agency's (EPA) online tool, ENERGY STAR Portfolio Manager® (opens in new window) and use the tool to submit data to the City. This data informs gives building owners about a building's energy and water consumption compared to similar buildings, and tracks progress year over year to help in energy efficiency planning.

Save Money- Turn Off the heat:

Heat and hot water are required to be provided for all tenants (although based on your lease you may be required to pay for gas, fuel, or electricity to run heating equipment).

 

Property owners are required to provide hot water 365 days per year at a constant minimum temperature of 120 degrees Fahrenheit.Between October 1st and May 31st, a period designated as "Heat Season," property owners are also required to provide tenants with heat under the following conditions:

·         Between the hours of 6:00 AM and 10:00 PM, if the outside temperature falls below 55 degrees, the inside temperature is required to be at least 68 degrees Fahrenheit; and,

·         Between the hours of 10:00 PM and 6:00 AM, if the temperature outside falls below 40 degrees, the inside temperature is required to be at least 55 degrees Fahrenheit.

Real Property Income and Expense (RPIE) Statements

The Department of Finance (DOF) needs income and expense information each year to value your property accurately. The RPIE-2017 statement must be filed online unless you request and are approved to file a paper version (utility property owners must file online).

The deadline to file is June 1, 2018.

The RPIE-2017 will be used to determine your property’s value for the 2018/19 tax year that will begin on July 1, 2018. DOF uses the information reported in the RPIE and/or information from similar properties to estimate the market value of your property for tax purposes.

Who Needs to Register

Property owners of residential buildings are required by law to register annually with HPD if the property is a multiple dwelling (3+ residential units) or a private dwelling (1-2 residential units) where neither the owner nor the owner's immediate family resides.

Building registrations must also be filed annually by September 1st or whenever ownership changes or whenever the information on a valid registration changes (example, new managing agent or site management).  HPD uses the contact information supplied in the registration for all official notifications, as well as in the event of an emergency at the property.

How to Register

The easiest way to register is by using HPD'S PROPERTY REGISTRATION ONLINE SYSTEM(PROS). With this tool, owners and managers can:

  • Update registration forms annually or as changes occur. (You still need to print, sign and mail).
  • Create new property registrations. 
  • Review and print a building's registration history and any submitted forms. 
  • Receive notifications electronically when forms are accepted or rejected. 
  • Link to the Department of Finance (DOF) for payment of the property registration fee.

Complete the online form and print it, or complete the form that is mailed to you.  Once the form is completed, mail the form, signed and dated by the agent and the property owner listed on the registration form, to:

Pay the registration fee.  A $13 registration fee will be billed directly by the Department of Finance as part of your property tax collection Statement of Account, annually due on July 1st. 

If you wish to apply your payment to only the Property Registration fee, you may pay online with a credit card at nyc.gov/payonline or visit a DOF Business Center.

If you wish to mail a payment, you must indicate clearly that the payment is for the Housing- Property Registration charge and include the Borough, Block and Lot of the property on your check (this information is on your registration form).  Also indicate your Account number, which is the property registration number for your property.  After Your Property Is Registered

 After HPD receives your form and payment, HPD will notify you by mail or email. All notifications will be sent to the address of the managing agent identified on the form or to the owner if the owner is the manager. If you do not receive a receipt or a correction form within 2-4 weeks of submitting your form, you can check using HPDONLINE or through your PROS account to verify whether you validly registered.  Contact the Registration Assistance Unit if you have questions or concerns regarding corrections or questions.

 

Failure to Register: Buildings without valid property registration are subject to civil penalties of $250-$500, may be issued Orders, and will be ineligible to certify violations, request a Code Violation Dismissal, or initiate a court action to recover possession of the premises for nonpayment of rent.

If you receive an Order to register, you must register to remove it. Once your registration is valid, HPD will administratively remove the violation; you do not need to take any additional action. Follow the instructions on this page or on the back of the Order to obtain a registration form or contact HPD with questions.

October 1st- Starts
