HPD Violations

There are numerous types of violations in New York City. Three of the most common are HPD, DOB, and ECB violations. Below you will find a basic breakdown of each of these violations, what they mean, and what action should be taken.

A Department of Housing Preservation and Development Violation, better known as an HPD violation, is issued when building codes are not complied with. These types of violations are not heard through the Environmental Control Board (ECB) and have unique requirements for being resolved. In most cases, a Notice of Violation will be sent to the property but there are exceptions.

An HPD violation is issued with a class designation that determines the timeframe for correction and the penalty for not completing the correction. The classes are as follows:

  • C – Immediately Hazardous. Depending on the specifics, it will be issued with either 24 hours or five days given for correction. There are two exceptions: lead and window guard corrections get 21 days, while heat and hot water violations must be handled immediately. The penalty for not immediately correcting heat and hot water issues is $250 per day. This is ERP eligible.
  • B – Hazardous. This violation comes with 30 days or five days for correction, depending on the specific violation. Civil penalties and litigation are potential penalties.
  • A – Non-Hazardous. For this violation, 90 days or 14 days are allotted for correction, depending on the specifics. Potential penalties include fines and civil lawsuits.
  • B – Hazardous – Order to Correct. The time to correct this will vary from immediately to months. Penalties include civil penalties and municipal litigation.

The Notice of Violation will always include the time period designated for correction. The entity making the correction must then complete it within that time frame and either mail a CIV-194 or perform eCertification to show they have made the necessary changes.

 

 

 

Abbreviation Meaning
Actual Cert. Date The date HPD received a valid certification document indicating that the condition was corrected. HPD sends notice of all timely certified violations to tenants for apartment specific conditions if HPD has a contact name. Except for lead-based paint violations, which must also be re-inspected to be closed, timely certified violations are closed after 70 days if there is no inspection which determines that the condition was not corrected.

A Units

An "A unit" is an apartment, which includes one or more living rooms occupied as a unit separate from all other rooms within a dwelling, with lawful sanitary facilities and a lawful kitchen or kitchenette for the exclusive use of the family residing in such unit.

B Units
<LEGL_CLS_B>
A "B" unit can be a rooming unit, single room occupancy unit or a hotel unit. A rooming unit shall mean one or more living rooms arranged to be occupied as a unit separate from all other living rooms, and which does not have both lawful sanitary facilities and lawful cooking facilities for the exclusive use of the family residing in such unit. A single room occupancy unit is the occupancy by one or two persons of a single room, or of two or more rooms which are joined together, separated from all other rooms within an apartment so that the occupant(s) thereof reside separately and independently of the other occupant(s) of the same apartment. A hotel unit is a unit in an inn having thirty or more sleeping rooms. 
Borough Each borough is assigned a number. 1-Manhattan, 2-The Bronx, 3-Brooklyn,4-Queens and 5-Staten Island.

Block An individual area of land which is usually enclosed by city streets. Each block is assigned a unique identification number by the Department of Finance.

Emergency Repair Program
If an HPD inspector verifies an emergency condition in a building, the last validly registered owner and managing agent of the property will be notified of said emergency condition by letter and/or by phone and instructed to repair the condition. If the owner fails to make the necessary repairs in a timely manner, HPD"s Emergency Repair Program (ERP) may repair the condition. If HPD"s ERP repairs the emergency condition, HPD, through the Department of Finance, will bill the owner for the cost of repairs. If the owner fails to pay the bill a lien is placed on the property.

NOV Issued Date The date that Notice of Violation was issued by the department. This date is the trigger for the setting of correction and certification dates.
Order No. Reference number assigned to a general description of the condition constituting a violation and the section of law violated.
* This symbol, which can appear after an Order No, indicates that the violation is a rent impairing violation, as defined in the Multiple Dwelling Law of the State of New York.  A rent-impairing violation is a condition within a multiple dwelling which constitutes, or if not promptly corrected will constitute, a fire hazard or a serious threat to the life, health or safety of occupants thereof.

Status The most recent standing for specific violation. A "NOV SENT" status indicates that a Notice of Violation (NOV) was sent to the building owner. A "False Cert" status indicates that the owner certified the violation was corrected but a subsequent inspection determined that the violation had not be corrected. A "NOV LATE" status indicates that the owner has not certified the violation was corrected within the time period specified. For a landlord to remove the "NOV LATE" status and clear a specific violation from the system he or she must correct the violation and then ask for a reinspection by filing a Dismissal Request form.
Status Date The date the determination was made of the status of a specific violation.

A Non-hazardous, such as minor leaks, chipping or peeling paint when no children under the age of six live in the home, or lack of signs designating floor numbers. An owner has 90 days to correct an "A" violation and two weeks to certify repair to remove the violation).
B Hazardous, such as public area doors not self-closing, inadequate lighting in public areas, or vermin. An owner has 30 days to correct a "B" violation and two weeks to certify the correction to remove the violation.
C Generally, Immediately hazardous, such as inadequate fire exits, rodents, lead-based paint, lack of heat, hot water, electricity, or gas. Generally, an owner has 24 hours to correct a C violation and five days to certify the correction to remove the violation.  If the owner fails to comply with emergency C violations such as lack of heat or hot water, HPD initiates corrective action through its Emergency Repair Program. Heat and hot water violations must be corrected immediately. Lead-based paint and window guard violations have a 21 day correction period.

Tenant Action: Cases commenced by one or more residential tenants against their landlords (and naming HPD as a party) seeking an order to correct violations and civil penalties for failure to timely correct violations.

Comprehensive: Cases in which HPD seeks the correction of all outstanding violations in a building and/or civil penalties for owners� failure to timely certify correction of violations and/or for failure to file a Multiple Dwelling Registration.

Comprehensive Supplemental: Cases in which HPD seeks a finding of contempt and/or additional civil penalties against landlords who have failed to comply with orders to correct violations.

4 Heat and Hot Water: Cases in which HPD seeks an order to restore and maintain heat and hot water at a residential building and civil penalties.
5 Heat and Hot Water Supplemental: Cases in which HPD seeks a finding of contempt and/or additional civil penalties against landlords who have failed to comply with orders to provide heat and/or hot water.

7 Access Warrant: HPD commences cases seeking access warrants when HPD inspectors and/or contractors and crews sent by HPD have been denied access to inspect and/or to repair conditions in a residential building.
8 Judgment Enforcement: When the Court issues a judgment against the owners of a building awarding civil penalties to HPD and the owners do not pay the amount due, HPD undertakes a variety of methods to collect the money due. The actions that HPD takes are called judgment enforcement.
9 7A Proceedings: Cases in which HPD seeks the appointment of an administrator for a building based on conditions or acts dangerous to life, health or safety, harassment and/or deprivation of services.
10 CONH: Before applying to the Department of Buildings for a permit to demolish or reconfigure some buildings, including single room occupancy multiple dwellings and some multiple dwellings in several zoning districts, the owner must obtain a Certification of No Harassment (�CONH�) from HPD. The owner submits an application and HPD investigates and determines whether to issue a CONH. If HPD determines that there is reasonable cause to believe that harassment occurred, a hearing is held before the Office of Administrative Trials and Hearings ("OATH"). After OATH issues its findings and recommendation, HPD determines whether to issue a CONH. A finding of harassment prevents the owner from obtaining certain types of demolition and alteration permits for three years in the case of single room occupancy multiple dwellings and permanently (unless the owner complies with an affordable housing requirement) in the case of other properties.
