NYC Official Bin Requirement for Residential Buildings (1–9 Units)
Beginning June 1, 2026, owners and managers of certain residential properties in New York City will be required to use official NYC trash containers, commonly referred to as “NYC Bins,” for garbage setout. The program is part of New York City’s continuing effort to reduce rat activity, improve street cleanliness, and modernize waste collection practices throughout the five boroughs. The requirement applies primarily to single-family homes, two-family homes, and residential buildings containing up to nine dwelling units.
The new rules are being implemented by the New York City Department of Sanitation (“DSNY”) under the authority granted by the New York City Administrative Code and DSNY regulations. The Department of Sanitation has expanded containerization requirements citywide in response to ongoing public health and sanitation concerns associated with exposed trash bags left on sidewalks. Property owners who fail to comply with official container requirements may become subject to sanitation violations and monetary penalties issued by sanitation enforcement officers.
Under the program, trash placed out for collection must be stored inside an approved “Official NYC Bin.” These containers are specifically designed to meet DSNY standards for durability, compatibility with automated collection systems, and resistance to rodent intrusion. The bins are manufactured to standardized specifications and bear official New York City sanitation markings. Although recycling and compost bins are also available through the program, the current requirement primarily mandates official containers for refuse/trash collection.
The legal authority for sanitation containerization requirements originates from several sections of the New York City Administrative Code, including provisions contained within Title 16 of the New York City Administrative Code relating to waste storage, collection, and disposal. DSNY also enforces rules contained in Title 16 of the Rules of the City of New York (“RCNY”), which regulate the manner in which refuse must be stored and placed out for collection. Property owners should additionally review applicable DSNY notices, operational guidance documents, and enforcement bulletins issued in connection with the citywide containerization initiative.
The City has publicly stated that one of the primary goals of the Official NYC Bin program is rat mitigation. Loose garbage bags left directly on sidewalks create a food source for rodents and contribute to unsanitary street conditions. By requiring sealed, rodent-resistant containers, DSNY aims to reduce infestations and improve overall neighborhood cleanliness. The City has also indicated that standardized bins may improve collection efficiency and support future automated sanitation operations throughout New York City.
According to DSNY guidance, Official NYC Bins are available for purchase through authorized retail and delivery partners, including participating The Home Depot locations and certain third-party delivery services. The City has promoted the bins as durable, weather-resistant, and relatively affordable for most residential property owners. Owners and managers are encouraged to obtain compliant containers before the June 1, 2026 enforcement date to avoid potential violations once enforcement begins.
Property owners should understand that sanitation regulations may continue to evolve as DSNY expands containerization requirements to additional building classes and collection types.
