NYC HPD Dismissal Request Form (DR-1) Guide

The HPD Dismissal Request Form (DR-1) is used to request that the New York City Department of Housing Preservation and Development (HPD) reinspect your property and remove (dismiss) violations that have already been corrected. Simply correcting a violation does not automatically remove it from HPD's records. An HPD inspector must verify that the condition has been corrected before the violation can be officially dismissed.


What Does the HPD Dismissal Request Form Do?

When HPD issues a violation, the property owner is responsible for correcting the condition. However, fixing the issue alone does not close the violation in HPD's system.

The DR-1 form requests an official HPD reinspection. If the inspector confirms that the violations have been corrected, they will be dismissed and removed from the list of open violations.


Section 1 – Building to Be Inspected

This section identifies the property that HPD will inspect.

You must provide:

  • Building address

  • Borough

  • Number of dwelling units

  • Property Registration Number (if applicable)

  • Which violations should be inspected

You have two options:

ALL

Select this option if you want HPD to inspect every open violation at the property.

ONLY

Select this option if you only want HPD to inspect specific violation numbers.

For most buildings where all violations have been corrected, selecting ALL is the easiest option.


Section 2 – Requestor Information

Only certain individuals are authorized to submit a Dismissal Request.

The requestor must be:

  • The owner listed on the HPD Property Registration

  • The managing agent listed on the HPD Property Registration

Provide:

  • Name

  • Mailing address

  • Telephone number

  • Email address

The requestor must sign the certification confirming that:

  • The listed violations have been corrected.

  • They understand HPD will reinspect the property.

  • They understand HPD may issue new violations if inspectors observe additional Housing Maintenance Code violations during the inspection.

This is one of the most important sections of the form.


Section 3 – Contact Information for Scheduling the Inspection

If someone other than the owner or managing agent will meet the inspector, list that person's contact information.

Examples include:

  • Superintendent

  • Building manager

  • Porter

  • Managing agent

  • Maintenance staff

Include:

  • Name

  • Telephone number

  • Email address

HPD will use this information to schedule the inspection and arrange access to the property.


Important Warning Before Requesting an Inspection

Many property owners believe HPD will only inspect the violations listed on the request. This is incorrect.

During a Dismissal Request inspection, HPD inspectors may issue new violations for any Housing Maintenance Code violations they observe, including but not limited to:

  • No heat

  • No hot water

  • Missing or defective smoke detectors

  • Missing or defective carbon monoxide detectors

  • Missing required HPD signs

  • Mold

  • Rodent or pest infestation

  • Self-closing apartment or public hallway doors that do not function properly

  • Lead-based paint hazards

  • Unsafe means of egress

  • Illegal window gates

  • Double-cylinder deadbolt locks

  • Missing window guards

This list is not exhaustive. HPD inspectors may cite any condition that violates the Housing Maintenance Code.


Dismissal Request Fees

The Dismissal Request inspection requires payment.

Building Type Fee
Private Dwelling (1–2 Family) $250
Multiple Dwelling (3+ Units) with 1–300 Open Violations $300
Multiple Dwelling with 301–500 Open Violations $400
Multiple Dwelling with 501 or More Open Violations $500
Alternative Enforcement Program (AEP) Building $1,000

Payment must be made by:

  • Certified Check

  • Money Order

Checks and money orders must be payable to the NYC Department of Finance.


Reasons HPD May Reject Your Request

HPD may reject a Dismissal Request if:

  • The property's annual Property Registration is not current.

  • Emergency repair charges owed to HPD have not been paid.

  • The owner, managing agent, or property is involved in pending HPD litigation.

  • Outstanding HPD judgments remain unpaid.

It is recommended that these issues be resolved before submitting the application.


Inspection Timeframe

According to HPD, inspection results are generally mailed within:

  • 45 business days for requests received between June 1 and September 30

  • 90 business days for requests received between October 1 and May 31

These are target processing times and are not guaranteed.


Post-Inspection Self-Certification (CV-1)

HPD offers a self-certification process in certain situations.

If inspectors:

  • Inspect at least 50% of the requested violations, and

  • Confirm that at least 75% of those inspected violations have been corrected,

some remaining uninspected violations may qualify for dismissal through the CV-1 Self-Certification process.

Certain violation types and many public area violations are not eligible for self-certification.


Violations That Require Additional Documentation

Some violations require more than a successful inspection before they can be dismissed.

Lead-Based Paint Violations

Lead violations generally require:

  • Proper lead-safe work practices

  • Affidavits

  • Supporting documentation

  • HPD inspection and verification


Property Registration Violation (Order 780)

Requires:

  • A current HPD Property Registration filing


Alteration Violations (Orders 491, 494, 495, 741)

May require:

  • Approved Department of Buildings (DOB) permits

  • Approved plans

If the alteration has been removed and restored to the legal condition, documentation may not be required.


Mold Violations (Order 550)

Generally require:

  • Affidavit of Mold Assessment and Remediation

  • Additional documentation depending on who performed the remediation work


Affidavit of Ownership (Last Page)

The Affidavit of Ownership is only required for certain applicants.

It is used when:

  • You own a one- or two-family home and live at the property (Property Registration is not required).

  • You own an individual condominium unit.

  • You own shares in a cooperative and are requesting dismissal only for violations affecting your apartment.

The affidavit must be notarized before submission.


Practical Tips Before Filing an HPD Dismissal Request

Before requesting an HPD dismissal inspection, verify that:

  • Every requested violation has been completely corrected.

  • All required HPD signs are properly installed and posted.

  • Smoke detectors and carbon monoxide detectors are installed, operational, and comply with current NYC requirements.

  • Apartment entrance and common area doors are self-closing where required.

  • Public areas are free from Housing Maintenance Code violations.

  • The property's annual HPD Property Registration is current.

  • Any required documentation for lead paint, mold remediation, alterations, or other special violations is complete and ready to submit.

Scheduling an HPD dismissal inspection before ensuring full compliance may result in additional violations being issued. Performing a thorough building inspection beforehand can help improve the likelihood of successfully clearing your HPD violations.
