HPD Fire Safety Notice Compliance Letter – Step-by-Step NYC Building Owner Guide

What this letter means

HPD inspected the building on July  2026 and found that one or more apartments did not have the required Fire and Emergency Preparedness Notice—commonly called the Fire Safety Notice—posted inside the apartment entrance door.

The letter specifically states that you do not have to submit a certification or response to HPD or FDNY. Your obligation is to correct the condition promptly and maintain proof that the building complies.

Step-by-step compliance procedure

1. Determine whether the building is combustible or noncombustible

This determines which notice must be installed.

Use the Non-Combustible Construction / Fireproof Building Notice only when:

  • The current Certificate of Occupancy or Letter of No Objection identifies the building as noncombustible or fireproof; or
  • If no such document exists, a New York State registered architect or professional engineer has certified the building as noncombustible.

Otherwise, the FDNY rule requires the building to be treated as combustible construction, even when the exterior appears to be brick or masonry.

Do not select the fireproof notice merely because the building is brick.

Check the building’s Certificate of Occupancy, Letter of No Objection, or obtain confirmation from an architect or engineer. When uncertain, obtain professional verification before selecting the notice.

2. Obtain the correct FDNY notice

Use the current official version:

  • Fire and Emergency Preparedness Notice — Combustible Construction, or
  • Fire and Emergency Preparedness Notice — Non-Combustible Construction

FDNY provides both official forms on its Emergency Preparedness reference page.

The dwelling-unit notice must generally be:

  • 5½ × 8½ inches
  • Clearly legible
  • Permanently printed
  • metal signs with double sided tape, 3 mil sticker ,Laminated with firm backing, framed under a clear cover
  • Securely attached, not temporarily taped or placed loosely on the door

3. Install a notice inside every apartment entrance door

Do not limit correction only to the apartment identified by the inspector. Inspect and correct every apartment in the building.

Install one correct notice:

  • On the inside surface of each apartment’s principal entrance door
  • Securely attached with adhesive or mounting hardware
  • With the entire notice positioned between 4 feet and 5½ feet above the floor

Replace any notice that is:

  • Missing
  • Torn
  • Painted over
  • Faded or illegible
  • Incorrect for the building construction type
  • Loose or improperly positioned

NYC requires these notices in apartment buildings containing three or more apartments.

4. Document every apartment

Create an inspection sheet containing:

A matching Fire and Emergency Preparedness Notice must also be posted:

  • Near the common mailbox area; or
  • If there is no common mailbox area, near the elevators or main stairway.

The common-area notice may be as large as 8½ × 11 inches. It must also be positioned between 4 feet and 5½ feet above the floor.

6. Post the completed Building Information Section metal sign available at www.hpdsigns.nyc

Next to the common-area Fire and Emergency Preparedness Notice, post Part I — Building Information Section of the NYC Apartment Building Emergency Preparedness Guide.

It should accurately state information such as:

  • Building address
  • Owner or managing-agent information
  • Number of floors
  • Approximate construction year
  • Combustible or noncombustible construction
  • Sprinkler coverage
  • Fire-alarm information
  • Means of egress and stairway information

The owner is responsible for the accuracy of this information. The completed Part I must be posted together with the common-area notice.

7. Verify the “Close the Door” notices ( buy online with www.hpdsigns.nyc)

The letter also reminds you to inspect the stairwell doors.

A compliant Close the Door Notice should be posted on every stairwell door as required. FDNY supplies the current notice in two approved formats.

Also verify that apartment entrance doors and required public-hall or stair doors:

  • Self-close completely
  • Self-latch
  • Are not held open
  • Are not obstructed

This particular letter concerns the missing notices, but an inspector may review related fire-safety conditions during a later inspection.

8. Verify the lobby postings

Confirm that the lobby or common area contains the required materials applicable to the building, including:

  • Fire and Emergency Preparedness Notice
  • Completed Building Information Section
  • Hurricane Evacuation Zone Notice, where required

The rule requires owners to prepare, post and maintain these materials.

  3. Individual Emergency Preparedness/Evacuation Planning Checklist
  4. Current 2025–2026 Fire and Emergency Preparedness Annual Bulletin

The Guide must generally be distributed:

  • At least once every three calendar years
  • To new residents when they take occupancy
  • To new building staff when employment begins
  • Within 60 days after a material building change affecting the Guide

The annual bulletin must be distributed annually. Keep delivery records, such as signed receipts, mailing certificates, delivery affidavits or reliable electronic-transmission records.

10. Use either tenant certification or physical inspections

For continuing compliance, establish one of the two permitted systems:

Option A — Resident certification

Distribute the FDNY resident notice and certification form, requesting that each resident confirm the notice is posted and maintained.

Option B — Building inspection program

Have the owner, managing agent or authorized representative physically inspect every apartment at least once every three years.

Document:

  • Successful inspections
  • Attempted inspections
  • Whether the notice was present
  • Whether it was damaged
  • Any replacement or corrective action taken

Because HPD has already identified a failure, a physical inspection of all apartments now is the safer option.

11. Do not send anything unless HPD or FDNY separately requests it

Based on the wording of this letter:

  • Do not mail the letter back.
  • Do not submit an HPD violation certification merely for this advisory letter.
  • Do not submit photographs unless requested.
  • Do not assume that installation in one apartment completes the obligation.

Retain your complete compliance file in case HPD or FDNY performs another inspection.

Immediate action checklist

Complete these actions as soon as possible:
