Local Law 86 of 2025 amended Housing Maintenance Code (HMC) § 27-2104 to improve transparency for tenants living in buildings that contain rent-stabilized apartments. Purpose of the Law

The purpose of Local Law 86 is to increase awareness of tenant rights and improve compliance with New York State rent registration requirements. Many tenants may not realize that their apartment could be rent stabilized. By requiring a prominently displayed notice, the City helps tenants learn:

  • Which Buildings Must Post the Notice?

The notice is required in:

  • What Must the Notice Include?

HPD has created an official notice that owners must use. The notice includes:

Although the law simply requires a conspicuous location, best practice is to install the notice:

  • At eye level (approximately 48–60 inches from the finished floor to the center of the notice).

  • In a well-lit location.

  • Where it remains continuously visible without obstruction.


Existing Serial Number Sign Still Required

Section 27-2104 continues to require the building's HPD Serial Number Sign, which identifies:

  • Building registration serial number.

  • Owner.

  • Managing agent.

  • Rental payment agent (if different).

Local Law 86 adds the Rent Stabilized Dwelling Units Notice; it does not replace the required HPD Serial Number Sign. Both notices may be required in the same building.


Owner Responsibilities

Owners of buildings containing rent stabilized apartments must:

  • Post the official HPD notice.

  • Keep the notice continuously displayed.

  • Ensure the notice remains legible.

  • Replace damaged or missing notices.

  • Continue filing annual rent registrations with DHCR.

  • Provide each tenant with registration information relating to their apartment as required by state law.


Penalties for Non-Compliance

Subdivision (c) of HMC § 27-2104 provides that owners who fail to post the required notice are subject to civil penalties under HMC § 27-2115(a). HPD may issue violations for failure to comply with the posting requirement.


Effective Date

Local Law 86 became effective 210 days after enactment, and HPD began enforcing the requirement on January 26, 2026. Buildings containing one or more rent stabilized units are expected to have the required notice posted from that date forward. (NYC Government)
