New York City law requires building owners and property managers to address lead-based paint hazards every time an apartment becomes vacant in buildings built before 1960, or built between 1960–1978 where lead paint is known or presumed. Under NYC Local Law 1 of 2004 and Local Law 31 of 2020, owners must remediate all lead paint hazards, remove lead paint from friction and chewable surfaces, properly treat windows and doors, and ensure all affected areas are smooth, sealed, and cleanable—before a new tenant moves in. These requirements apply regardless of whether a child will live in the unit, and tenant waivers are not allowed.

Failure to comply can result in HPD violations, fines, enforcement actions, and legal liability. All work must be performed using certified lead-safe work practices, and documentation must be retained for inspections and audits.
