Understanding NYC HPD Mold Violations

New York City requires residential property owners to maintain safe, healthy living conditions by preventing and correcting mold and indoor allergen hazards. Under Local Law 55 of 2018, owners must remove mold, eliminate the moisture source causing it, and maintain buildings to prevent mold from returning. Buildings with three or more residential units also have ongoing responsibilities to inspect for indoor allergen hazards, including mold, rodents, and cockroaches, and to respond promptly to tenant complaints.

How Mold Violations Are Corrected

When HPD issues a mold violation, the correction process depends on the size of the building. Residential buildings with one to nine dwelling units may either perform the remediation following HPD's Local Law 55 Safe Work Practices or voluntarily hire a licensed mold remediation contractor. Buildings with ten or more dwelling units must retain two separate New York State licensed companies—one mold assessor and one mold remediator—to inspect, remediate, repair the underlying moisture condition, and complete the required compliance documentation before submitting certification to HPD.

Owner and Tenant Responsibilities

Property owners must repair leaks, plumbing failures, roof or window leaks, condensation, and any other moisture conditions that contribute to mold growth. They must also perform annual inspections where required, safely remove mold, follow Integrated Pest Management (IPM) practices, and provide tenants with information about indoor allergen hazards. Tenants play an important role by keeping their homes clean and dry, promptly reporting leaks, mold, pests, or structural damage, allowing access for repairs, and contacting 311 if hazardous conditions are not addressed.

Certification and Compliance

After all mold has been removed and the underlying moisture condition has been permanently repaired, owners must submit the appropriate Affidavit of Compliance (AF-7 or AF-8, depending on building size) together with any required supporting documentation. HPD reviews the submission and may perform a reinspection before certifying the violation as corrected. Maintaining compliance with Local Law 55 helps protect tenant health, reduces asthma and indoor allergen risks, and prevents additional HPD enforcement actions or penalties.
