NYC Rent Transparency Posting Law
The New York City Council passed a new local law (Int. 1037-A) requiring landlords of buildings with rent-stabilized apartments to install a mandatory notice in the building’s common area. This law is meant to improve transparency for tenants and ensure owners comply with DHCR filing requirements.
- Who Must Comply
This law applies to any multiple dwelling (3+ units) that contains at least one rent-stabilized apartment.
If the building has even one rent-stabilized unit, the notice must be posted.
- What Must Be Posted
Landlords must post a DHCR Rent Stabilization Notice at the building entrance in a conspicuous location, containing the following required information:
- A statement that the building contains rent-stabilized units
- Instructions for tenants on how to check if their individual unit is registered
- DHCR Office of Rent Administration phone number
- DHCR website address for rent-stabilization inquiries
- A note that owners must file annual DHCR rent registrations and provide tenants the corresponding information
- A warning that owners may face penalties for failing to file
The sign must be:
- In English and Spanish
- Include a link for the notice in all designated NYC languages
The city may later update the sign if DHCR or relevant agencies change.
- Additional Requirement for HPD
Before the law becomes active, HPD (Housing Preservation & Development) must establish an agreement with DHCR to access data confirming whether a building contains rent-stabilized units.
This allows HPD to enforce the posting requirement.
- Penalties for Non-Compliance
Owners who fail to post the required sign will be subject to civil penalties under NYC Admin Code §27-2115(a) (the same enforcement structure as other HPD violations).
- Effective Date
- The posting requirement becomes law 210 days after enactment.
- The HPD–DHCR data-sharing agreement section takes effect immediately.
