The New York City Council has passed the “Rent Transparency Act” (Int. 1037-A-2024), a new local law designed to increase transparency for tenants living in buildings with rent-stabilized units. This landmark legislation mandates clear public notification of rent stabilization status within qualifying residential buildings, aiming to protect tenant rights and improve regulatory compliance.

Key Provisions of the Rent Transparency Act

  1. Mandatory Signage in Rent-Stabilized Buildings
    Property owners of multiple dwellings that contain one or more rent-stabilized units must post a visible notice at the building’s main entrance. This notice must:

    • Declare that the building includes rent-stabilized units.

    • Provide tenants with instructions to check their unit’s status through the New York State Division of Housing and Community Renewal (DHCR).

    • Include DHCR’s contact number and website for rent stabilization inquiries.

    • Be displayed in English and Spanish, with access to additional translations as defined by NYC law.

  2. Identification Sign Requirements

    • Owners must also post a sign showing the dwelling's serial number and the names and contact details of the building owner, managing agent, and rent collector (if different).

  3. Civil Penalties for Non-Compliance

    • Failure to post the required rent transparency signage will result in civil penalties as defined under Section 27-2115 of the NYC Administrative Code.

  4. Data-Sharing for Enforcement

    • The NYC Department of Housing Preservation and Development (HPD) is required to establish a data-sharing agreement with NYS DHCR to access rent stabilization data and support enforcement efforts.

Implementation Timeline

  • The signage requirements under the Rent Transparency Act will take effect 210 days after it becomes law.

  • The HPD-DHCR data agreement provision takes effect immediately upon enactment.
